Standard and Extended Warranty Terms and Conditions

Please contact AUSCAN Support for all warranty and product support requests.

These Terms and Conditions apply to Standard and Extended Warranties for products purchased from AUSCAN and through www.auscan.com.au.

In the event that you have a warranty claim in respect of a Product delivered within Australia, you may be asked to return the relevant Product to an authorised Australian support centre.

These Terms and Conditions constitute a contract between the customer (“you”) and Launch Tech Au Pty Ltd, ABN 85 613 864 387, trading as Launch Tech Australia (“AUSCAN”, “we”, “us” or “our”).

These Terms and Conditions apply to Standard and Extended Warranties for Products supplied through www.auscan.com.au.

AUSCAN supplies and supports warranties relating to Products offered and supplied through AUSCAN, including authorised LAUNCH products (“LAUNCH Products”).

Please note that you must keep your original product packaging where reasonably possible for warranty service. If you do not have the original packaging, you are responsible for safely packaging your Product for transport. AUSCAN accepts no liability for damage caused by inadequate packaging during transit.

AUSCAN provides the warranties and product support set out in these Terms and Conditions in relation to Products offered and supplied through the AUSCAN website.

The warranties and product support provided by AUSCAN apply irrespective of:

  • the identity of the manufacturer of the Product; and
  • whether or not the manufacturer provides its own warranty or product support in relation to the Product.

For the avoidance of doubt:

  • We make no representations or warranties regarding the existence, non-existence, validity, availability, terms or conditions of any additional warranty or product support that may or may not be offered by the manufacturer of the Product; and
  • Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. The warranties and product support offered under these Terms and Conditions are in addition to your rights and guarantees under the Australian Consumer Law.

Warranty Terms

Subject to the Terms and Conditions set out below, AUSCAN agrees to repair or replace a Product supplied by AUSCAN at its own cost where the Product does not perform in accordance with the manufacturer’s specifications during:

  • the Standard Warranty period of 12 months; or
  • the applicable Extended Warranty period, commencing on the date of delivery of the Product. Where there is no proof of delivery, the delivery date will be assumed to be three business days from the date the Product was dispatched; or
  • in the case of replacement parts, 90 days from the date of replacement or the unexpired portion of the original Product warranty period, whichever is longer.

The benefits provided to you under this contractual product warranty are in addition to other rights and remedies available to you under applicable law.

Proof of purchase, such as an invoice or paid order confirmation, must be provided when requesting service under a Standard or Extended Warranty.

AUSCAN requires customers requesting service under a Standard or Extended Warranty to follow reasonable directions provided by AUSCAN staff in relation to troubleshooting, diagnosis, repair or replacement under these Warranty Terms and Conditions.

Where a Product is faulty or damaged upon delivery, photographic evidence of the fault or damage must be submitted to AUSCAN Support before the Product can be repaired or replaced in accordance with these Terms and Conditions.

AUSCAN reserves the right to replace the Product or relevant part with the same or an equivalent Product or part rather than repair it.

Where a replacement is provided, AUSCAN may determine the closest equivalent Product within its then-current product range. The replacement Product may differ from the original Product in size, specifications or appearance where reasonably necessary.

AUSCAN may use refurbished replacement parts where appropriate.

Replacement of a Product or part under the Standard Warranty or Extended Warranty does not extend or restart the original Standard Warranty or Extended Warranty period.

If AUSCAN is unable to repair or replace the Product, the customer may be provided with store credit or a refund of the Product purchase price, at AUSCAN’s election and subject to applicable consumer law.

Any store credit or refund under this clause will exclude the original Delivery Cost unless otherwise required by law.

Where a replacement, refund or store credit is provided under Section 6 or 6.1, the faulty Product may become the property of AUSCAN.

Where AUSCAN authorises warranty service for a Product, you will be responsible for arranging delivery of the Product to the appropriate authorised repair centre unless otherwise advised by AUSCAN.

The Product must be safely and securely packaged for transport.

Where applicable, AUSCAN will cover the cost of returning the serviced Product to the customer.

Alternatively, the customer may take the Product directly to an authorised repair centre where AUSCAN has specifically authorised this in writing.

Where the customer is located outside Australia, AUSCAN may require the Product to be sent to Australia as directed by AUSCAN.

The customer is responsible for inspecting all goods received from AUSCAN upon arrival. Where goods have been damaged in transit, the customer must report the damage to AUSCAN within three days of receiving the Product.

Failure to report physical damage within three days may affect a warranty claim relating specifically to transit or physical damage, subject to the customer’s rights under Australian Consumer Law.

AUSCAN reserves the right to determine which authorised repair centre, including AUSCAN’s internal repair facilities, is the appropriate service location in any particular circumstance.

The Product will remain at the customer’s risk while in transit to and from an AUSCAN authorised repair centre, except where otherwise required by applicable law.

AUSCAN may seek reimbursement of reasonable costs incurred where a Product is found to be in good working order or where it is determined that the Standard Warranty or Extended Warranty does not apply under Section 17.

AUSCAN reserves reasonable discretion to determine whether a Product is performing in accordance with the manufacturer’s specifications, subject to applicable law.

Standard and Extended Warranties may be transferred to a new owner of a Product originally purchased from www.auscan.com.au, provided AUSCAN is informed via the Support Centre within seven days of the date of transfer.

Extended Warranties may be available for selected Products as listed on the AUSCAN website.

Where available, an Extended Warranty may be purchased up to 14 days after delivery of the relevant Product unless otherwise stated.

Where an Extended Warranty is purchased, it replaces the 12-month Standard Warranty period with the applicable Extended Warranty period, for example two or three years.

AUSCAN may terminate an Extended Warranty by written or email notice to the customer where, in AUSCAN’s reasonable opinion, the Product has been used contrary to its intended specifications or conditions of use.

Where applicable, AUSCAN may provide a pro-rata refund for the unused portion of the Extended Warranty, less reasonable administration expenses, subject to applicable law.

To the full extent permitted by law, the Standard Warranty and Extended Warranty will not apply to a Product:

  • where the Product has not been installed, operated, maintained or used in accordance with the manufacturer’s instructions or specifications;
  • where the factory-applied serial number has been altered or removed;
  • where the Product has suffered damage, malfunction or failure resulting from unauthorised alterations to hardware or software, accident, misuse, abuse, fire, liquid spillage, incorrect adjustment of controls, incorrect voltage, power surges or dips, thunderstorm activity, force majeure events, voltage supply problems, tampering, unauthorised repairs, defective or incompatible accessories, computer viruses, exposure to abnormally corrosive conditions, or entry by insects, vermin or foreign objects;
  • for damage arising during transportation, installation or relocation of the Product, or transportation costs associated with the Product or its parts, except where otherwise specified in these Warranty Terms and Conditions or required by law;
  • for third-party software or hardware not included with the Product as originally configured by the manufacturer;
  • for defective pixels, including dead or stuck pixels, arising in LED or LCD screens or monitors, except where AUSCAN determines that the issue constitutes a panel fault or where otherwise covered by applicable consumer guarantees;
  • for any issue that does not constitute a failure of the Product to perform in accordance with its specifications;
  • for replacement or repair of consumable items, including batteries and cables, or lost parts and accessories;
  • for service and support relating to operating systems or software applications installed on the Product, except where required to assist in restoring the Product to its original factory settings; or
  • for servicing of a Product while it is located outside Australia, unless otherwise agreed by AUSCAN.

To the full extent permitted by law:

  • AUSCAN will not be liable for loss, damage or alteration to third-party hardware, software, programs, data or information stored on any media or part of the Product, or for indirect or consequential loss arising from loss of use, profits or revenue, except where such liability cannot legally be excluded;
  • AUSCAN’s aggregate liability in respect of claims under the Standard Warranty and Extended Warranty will not exceed the original purchase price of the Product or, at AUSCAN’s option, replacement of the Product with a like or similar Product, except where otherwise required by applicable law; and
  • AUSCAN excludes all other warranties, conditions, terms, representations and undertakings, whether express or implied, to the extent permitted by law.

These Standard and Extended Warranty Terms and Conditions, insofar as they relate to Products supplied by Launch Tech Au Pty Ltd trading as Launch Tech Australia under the AUSCAN business and website, are governed by the laws of the State of New South Wales, Australia.

The parties submit to the jurisdiction of the courts of New South Wales.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
